PACKING<\/h2>\n

It is extremely important to Danang Sculpture Foundation that each stone statue and stone product arrives whole and undamaged. We take utmost care in shipping and packing each item.<\/p>\n

Our stone statues are packed in firm foam boxes for air shipment (small sizes, under 50kgs) and in strong seaworthy wooden crates (bigger sizes) for sea shipment to prevent damage during transportation.<\/p>\n

For all our heavy large statues or stone products, we build a custom wooden crate to fit individual item dimensions so that it is packed safely for the journey.\u00a0 A pallet at the bottom of the crate helps it be easily handled by a forklift or crane during the shipping process.\u00a0 Wooden braces are used inside the crate to make sure that the item does not shift during its journey.<\/p>\n

All wooden crates are fumigated before shipment. A Certificate of Fumigation is provided together with other shipment documents for your custom clearance procedures.<\/p>\n

INTERNATIONAL INSURANCE<\/h2>\n<\/div>\n

We take utmost care to ensure that a statue or stone product is not damaged in shipping by packing each piece with care. However, the long journey from our site to your home is out of our control. We recommend you buy insurance for all risks (Insurance Condition A<\/strong>) from \u201cport to port\u201d for your shipment in case of loss or damage.\u00a0<\/p>\n

Port to port insurance
Some instructions in case of loss or damage<\/em><\/strong>\u00a0<\/p>\n

Please notice that your items are only insured to the port of discharge, not to your house. Therefore, please check your items before the reception at the port of discharge.<\/p>\n

At the port of discharge, please look over the crate. If there is any damage to the crate, please stop opening the crate but contact the local Insurance Agent stated in your Insurance Policy.<\/p>\n

If there is any damage to a sculpture or a stone product, please notify Danang Sculpture Foundation and Insurance company (Assurer) immediately so that the proper insurance measures can be taken.<\/p>\n

It is the duty of you (as the Assured) or your agent, in all cases to ensure that rights against carriers, bailees, or other third parties are properly preserved and exercised:<\/p>\n

\u2013 To make claim in written immediately on the Carriers, Port Authorities or other Bailees for any missing package<\/p>\n

\u2013 In no circumstances, except under written protest, to give receipts where the goods are in doubtful condition<\/p>\n

\u2013 To apply immediately for a survey if any loss\u00a0 or damage be apparent and claim in written on the Carrier or other Bailees for any actual loss\u00a0 or damage found a such survey<\/p>\n

\u2013 To give notice in writing to the Carriers\u2019 or other Bailees\u2019 representatives within three days of delivery if the loss or damage was not apparent at the time of taking delivery<\/p>\n

SUR\u200bVEY<\/h3>\n

In case of loss or damage within the scope of cover under the Insurance Policy, please notify directly and immediately about the state of cargoes damaged such as the kind, the quantity, and the value, as well as the nature of the package of cargoes damaged to the Assurer.<\/p>\n

Documentation of claims<\/h3>\n

To enable claims to be dealt with promptly, the Assured or their agents are advised to submit all available supporting documents without delay, including when applicable:<\/p>\n

\u2013 Original Policy or Certificate of Insurance<\/p>\n

\u2013 Original or copy of shipping invoices,\u00a0 shipping specifications and\/or weight notes<\/p>\n

\u2013 Original Bill of Lading and\/or other Contract of carriage.<\/p>\n

\u2013 Survey Report (if applying for a survey) and\/or other documentary evidence to show the extent of the loss or damage, attached original photographs.<\/p>\n

\u2013 Landing account or certificate and weight notes at the final destination<\/p>\n

\u2013 Copy of sea Protest and\/or extract of ship log (yes or no)<\/p>\n

\u2013 Correspondence exchanged with the Carriers and other parties regarding their liability for the loss or damage<\/p>\n

\u2013 Claims statement and other documents in support of Claims<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n

Insurance Condition A<\/strong><\/h3>\n

This insurance covers all risks of loss of or damage to the subject-matter insured except as provided in the following\u00a0<\/p>\n

EXCLUSIONS:<\/p>\n

1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 In no case shall this insurance cover
1.1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 loss damage or expense attributable to wilful misconduct of the Assured
1.2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured
1.3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 loss damage or expense caused by insufficiency or unsuitability of packing or\u00a0 preparation of the subject-matter insured (for the purpose of this Clause 4.3 \u201cpacking\u201d shall be deemed to include stowage in a container or liftvan but only when such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)
1.4.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 loss damage or expense caused by inherent vice or nature of the subject-matter insured
1.5.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above)
1.6.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel
1.7.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and\/or fusion or other like reaction or radioactive force or matter.
2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 2.1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 In no case shall this insurance cover loss damage or expense arising from
unseaworthiness of vessel or craft,<\/p>\n

unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject-matter insured,<\/p>\n

where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein.<\/p>\n

2.2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination unless the Assured or their servants are privy to such unseaworthiness or unfitness.
3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 In no case shall this insurance cover loss damage or expense caused by
3.1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent\u00a0 power
3.2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or any attempt thereat
3.3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 derelict mines torpedoes bombs or other derelict weapons of war.
